The principle

Where several parties appeal the same judgment in cassation and the Court decides one appeal without joining the others, a later appeal brought in time by a different party with a separate interest, on grounds not addressed in the first decision, must be admitted and decided if it meets the other conditions. The earlier decision's authority is respected by not reopening the grounds already decided, but it does not bar the other appeal, even if the second appellant was a party to the first.

The case and the decision

The Civil Chamber referred to the General Assembly two conflicting lines of authority on what happens to a second cassation appeal against the same judgment when a related appeal has already been decided without the two being joined. One line treated the second appeal as barred by the authority of the earlier ruling; the other allowed it.

The General Assembly reasoned that the Civil Procedure Law consistently seeks to avoid fragmenting a single case and producing inconsistent judgments, including in cassation. Where appeals reach the Court at different times and it decides one (by dismissing it, partly quashing the judgment or declaring it inadmissible) without noticing other pending appeals, a later appeal filed in time by a different party with an independent interest, on grounds not considered in the first decision, is that party's only route to have its grounds examined. Refusing it in the name of res judicata would deprive the party of its right of access to justice and impose a severe procedural penalty on a litigant that acted correctly, particularly as joining related appeals is not the parties' obligation. Procedure is characterised by its substance, and the effect of a decision is relative to its grounds. The Court of Cassation must review the application of the law and unify its interpretation, so a previous decision on another party's appeal that did not address these grounds cannot cancel the later appeal. What binds the chamber hearing the second appeal is respect for the reasons of the first decision, which it must not revisit; this preserves the earlier decision without withdrawing or overriding it, and accords with equality before the law. This is so even if the second appellant was represented in the first appeal.

The General Assembly (civil panel) adopted the principle that an appeal by the other party against the same judgment must be admitted where its grounds differ and its other conditions are met.

Why it matters

In multi-party commercial disputes, several parties often challenge the same appellate judgment. This decision ensures that one party's appeal is not lost because the Court of Cassation happened to decide a co-party's or opponent's appeal first. It also limits the second appeal to new grounds, so issues already decided are not reopened.
