Amending instrument recorded in the amendment notes of the Regulations Manual of the Financial Activities (Rulebook) (CMA Decision No. 13/Chairman of 2021). The CMA has consolidated its changes into that text and keeps this instrument in its archive of amending regulations.

Summary

Decision No. 09/Chairman of 2025 amended the Regulations Manual of the Financial Activities (the Rulebook, Decision No. 13/Chairman of 2021). The CMA lists it among the Rulebook's amending instruments, issued on 14 April 2025 and in force from 30 April 2025, but does not publish its text.

The CMA's consolidated Rulebook records two changes, both in Article 17 of Section One. It amended the article's title, which now reads Sanctions and Administrative Measures, and it added Clauses 6 and 7 on professional licensing examinations. Under Clause 6 the Authority may suspend a candidate from continuing the Authority's professional licensing examinations, pending investigation, where it suspects a breach of the examination terms, cheating or leakage of examination information. Under Clause 7, if the breach is proven, the Authority may refuse to approve the result, bar the candidate from that examination for up to 6 months, on a repeat offence bar the candidate from all licensing examinations and cancel any accreditation held, notify the candidate's employer, and share reports with the examination provider.

Who it applies to

Candidates for the Capital Market Authority's professional licensing examinations, approved employees of licensed firms, and the firms that employ them.

Key provisions

Penalties

Under the new Article 17(7): non-approval of the examination result, a ban of up to 6 months from the examination concerned, and for repeat offences a ban from all licensing examinations with cancellation of any accreditation, plus notice to the employer.

In practice — how Polaris handles it

Staff of CMA-licensed clients must pass the Authority's licensing examinations before taking approved positions. Polaris is not licensed by the CMA; when we prepare staffing and approved-job applications with a client's compliance adviser, we flag that examination misconduct can now cost a candidate both the result and existing accreditations.
