CMA Decision No. 8/Chairman of 2022 · UAE Federal
Amending instrument that changes the Listing and Trading of Commodities Regulations (CMA Decision No. 157/R of 2005). The CMA has consolidated its changes into the current text of the amended regulation and keeps this instrument in its archive of amending regulations.
Decision No. 08/Chairman of 2022 rewrote two definitions and three listing articles of the Listing and Trading of Commodities and Commodities Contracts Regulations (Board Decision No. 157/R of 2005) and one glossary term in the Regulations Manual of the Financial Activities (Decision No. 13/Chairman of 2021). Issued in Abu Dhabi on 25 February 2022, it took effect on its date of issue (Article 8). The CMA has consolidated the changes into its text of the 2005 regulations, where footnotes attribute them to this decision.
Articles 1 and 2 replace the definitions in Article 1 of the 2005 regulations, which since Decision No. 56 of 2012 had covered instruments approved by the Board; approval now rests with the Authority. Options contracts are now contracts giving the holder the right to buy or sell a specified amount of commodities, indices, currencies or other financial instruments approved by the Authority, on a set date or within a set period at an agreed price; futures contracts are contracts to buy or sell the same range of underlying assets on a set date at a price agreed at contracting, specifying quality, quantity, date and place of delivery under market rules. Article 3 replaces Article 5-12: the listing committee's decision goes to the Authority within 15 days and the Authority decides within 30 days, and may ask for further particulars. Article 4 replaces Article 5-13, requiring notice of the decision within one week of issue. Article 5 replaces Article 5-14: approval entitles the market to list the commodity or contract, and the market must inform the Authority within one week of listing. Article 6 redefines commodity contracts in the Rulebook glossary as contracts for commodities, indices, currencies or other approved financial instruments, such as options and futures. Article 7 repeals conflicting provisions.
Licensed commodities markets in the UAE, applicants for listing of commodities, options and futures contracts, brokers and members trading them, and the Capital Market Authority when deciding listing applications.

This amendment matters to clients trading or structuring derivatives on index and currency underlyings, because it widened the 2005 definitions beyond commodities. Polaris is not licensed by the CMA and does not arrange listings or trade derivatives. When a client asks whether a contract it plans to offer is a regulated commodity contract, we point to the current definitions, coordinate with its licensed broker or adviser, and keep the client company's corporate and AML records in order.
