Amending instrument that changes the Complaints Regulation (CMA Decision No. 45/CEO of 2016). The CMA has consolidated its changes into the current text of the amended regulation and keeps this instrument in its archive of amending regulations.

Summary

Administrative Resolution No. 72/CEO of 2018 allows complaints about financial market transactions to be filed in English. Article 1 adds a new paragraph to Article 12 of the Complaints Regulation (Administrative Resolution No. 45/CEO of 2016 on the Regulation for Complaints Relating to Financial Markets Transactions): by way of exception, a complaint or its supporting documents may be submitted in English, and the Authority may require the complainant to provide a certified Arabic translation of the complaint and documents if it considers this necessary. Article 12 otherwise requires a complaint to be submitted in Arabic, with the complainant's details, the respondent's details, a chronological account of the facts, the requests made and the supporting documents; the new paragraph is the only exception to the Arabic-language rule.

The resolution was signed by the Chief Executive of the Securities and Commodities Authority (now the CMA) in Abu Dhabi on 4 June 2018 and, under Article 2, took effect from its date of issue and is communicated to those who must implement it. The text is published as a single-page Arabic scan. The CMA has consolidated the change into the current Complaints Regulation, whose notes record a new paragraph added to Article 12 by this resolution.

Who it applies to

Investors and other complainants who bring complaints to the CMA about financial market transactions, and the licensed firms, markets and listed companies that are the subject of those complaints.

In practice — how Polaris handles it

Many of our clients are foreign shareholders who hold UAE-listed shares through personal or holding-company accounts, and when a broker dispute arises they ask whether they must work in Arabic. Polaris is not licensed by the CMA and does not represent parties before it; we explain the complaint route, prepare and certify corporate documents and translations, coordinate with licensed advisers or lawyers, and keep the client's corporate and UBO records in order for the filing.
